McKesson provides access to ELSEVIER GOLD STANDARD Drug Information, produced by ELSEVIER GOLD STANDARD Inc ("GS"). Although GS makes reasonable efforts to ensure the accuracy and reliability of ELSEVIER GOLD STANDARD Drug Information, USER acknowledges that McKesson, their affiliates, and their respective officers, directors, employees and information providers and GS, its affiliates, and their respective officers, directors, employees and information providers will not be held liable for any damages suffered or incurred by USER or any third person arising out of: a) any faults, interruptions or delays in ELSEVIER GOLD STANDARD Drug Information or its delivery, b) any use of or reliance on ELSEVIER GOLD STANDARD Drug Information by any person, or c) any inaccuracies, errors or omissions in ELSEVIER GOLD STANDARD Drug Information, irrespective of however such faults, interruptions, delays, inaccuracies, errors or omissions arise unless due solely and exclusively to the negligence or willful misconduct of GS. GS shall not be liable to USER for any loss, cost or damages resulting from any delays in delivery and/or non-delivery of the content. USER acknowledges that its sole and exclusive remedy in the event of such delay is to not accept this Agreement. GS does not represent or warrant that ELSEVIER GOLD STANDARD Drug Information will meet the objectives or needs of USER or any third party. GS makes no warranty of merchantability of ELSEVIER GOLD STANDARD Drug Information or of the fitness of ELSEVIER GOLD STANDARD Drug Information for any purpose. UNDER NO CIRCUMSTANCES WILL GS OR MCKESSON BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY CLAIM OF LOST INCOME OR PROFITS, IN ANY WAY ARISING OUT OF OR RELATED TO THIS AGREEMENT, EVEN IF McKESSON AND/OR GS HAVE BEEN ADVISED AS TO THE POSSIBILITY OF SUCH DAMAGES.
